Job Summary:
Reporting to the Assistant Director, Legal, this position is responsible for the provision of legal and strategic advice on a broad range of legal issues to all areas of the WCB, at all levels. The position is a key member of the Legal team, is a legal resource to the Chief Legal Officer, and has access to deal with confidential information in that capacity. The position reviews legal files, drafts legal documents, conducts research, provides legal advice, handles collection of overpayment files and addresses issues from external counsel and internal staff at all levels. The Legal Counsel acts on behalf of the WCB in judicial review applications and other litigation, including court appearances. This individual is also a trusted resource and a part of the decision-making team regarding a wide range of sensitive legal issues including WCB policy and procedure development, privacy, procurement, insurance, and contract negotiation.
Duties & Responsibilities:
Conducts legal research at the request of the Chief Legal Officer or the Assistant Director, Legal on any matter tangential to the practice of law as it affects the business operations of the WCB.
Provides oral and written legal advice to internal customers on an as needed basis independent of direction and supervision of the Chief Legal Officer and the Assistant Director, Legal.
Reviews files, requests for legal action (including those pertaining to overpayments and collections), Board policy and procedures, appeal processes, and relevant legislation. Determines appropriate action and prepares legal responses and/or resolutions.
Conducts legal research including evaluation of both legislation and case law. Determines and prepares legal opinions for the Board and other internal staff. Prepares pleadings, legal reports, and other legal documents for the Board and other internal staff. Summarizes case law and medical evidence for use in hearings, trials, legal opinions and providing legal advice to the Board. Develops and prepares legal arguments and briefs, evaluates and identifies factual and legal issues and decides upon applicable laws and appropriate strategy for legal matters, including for use in external hearings and trials.
In accordance with Board policy or The Freedom of Information and Protection of Privacy Act, attends to requests for release of information, and responds to privacy breach complaints (including investigations and responses to inquiries).
Communicates the Board’s position to external clients or their counsel as appropriate in various circumstances. Responds to telephone and written inquiries from Case Managers, workers, employers, or their counsel or representatives, and Court personnel.
Reviews and provides legal advice on internal WCB policy development, Records Management, and procurement planning.
Prepares, reviews, and provides legal and strategic advice as part of a decision-making team on confidential contract matters, including complex legal contracts, requests for proposals, and other legal procurement documents.
Qualifications:
Successful completion of a Law Degree (LL.B. or J.D.).
Five (5) years successful experience demonstrating the ability to do the following:
Thorough knowledge of Court procedure, legal terminology, legal documents and relevant legislation.
Knowledge of law pertaining to workers' compensation, negligence, insurance, personal injury, contracts, privacy, and procurement.
Superior skills in communicating orally and in writing.
Demonstrated ability to establish and maintain effective working relationships.
Ability to work independently.
Knowledge of Continuous Process Improvement principles would be an asset.

Workers’ compensation insurance is a provincial responsibility. Each Canadian province and territory has its own workers’ compensation legislation.
The Saskatchewan Workers’ Compensation Board (WCB) operates like an insurance company. We provide guaranteed benefits and programs to injured workers in industries covered by The Workers’ Compensation Act, 2013 and we protect registered employers from lawsuits when a workplace injury happens.
The Saskatchewan WCB was established in 1911 because of a historic compromise between Saskatchewan workers and employers. Under that compromise, workers injured on the job in covered industries do not have to pay for the benefits they receive or sue their employers to get them. Costs are paid entirely by Saskatchewan employers in covered industries. This is referred to as a no-fault insurance system, also referred to as the compensation system.
The WCB’s vision is to eliminate injuries and restore abilities. This is the fundamental driver of all that we do on behalf of our customers – the workers and employers of the province. The WCB is governed by The Workers’ Compensation Act, 2013.
The legal and policy department provides legal, legislative and policy advice and counsel to the WCB. These responsibilities include providing legal advice to WCB staff, developing policy directives that govern WCB staff and overseeing privacy and other legislative considerations.
