Overall Purpose
Reporting to the Chief Legal Officer, the Manager, Freedom of Information (FOI) and Privacy leads the Board’s access to information, privacy, and information governance programs. The Manager ensures compliance with the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) and other applicable legislation by overseeing FOI administration, privacy compliance, risk management, and the development of governance frameworks, policies, and practices. The Manager provides strategic leadership and expert advice to support transparency, regulatory compliance, and the effective protection of personal information across the organization.
Summary of Duties
- Lead the Board’s Freedom of Information (FOI) program and oversee all access to information requests under MFIPPA, ensuring timely, consistent, and legislatively compliant responses.
- Manage complex access requests, including records review, application of statutory exemptions and exclusions, preparation of decision letters and disclosure packages.
- Develop and enhance processes, procedures, and tools that support an effective, consistent and defensible FOI program.
- Represent the Board in appeals, mediation and related matters before the Information and Privacy Commissioner of Ontario (IPC).
- Lead the Board’s privacy management program, including the development, implementation, and continuous improvement of frameworks, policies, procedures, standards, and initiatives.
- Lead the investigation and management of privacy incidents, breaches and emerging privacy, access and information governance risks, including response coordination, risk assessment, mitigation strategies and regulatory reporting.
- Conduct and oversee privacy impact assessments (PIAs) and privacy risk assessments for programs, initiatives, vendors, educational applications, artificial intelligence tools, and cloud-based technologies.
- Monitor legislative and regulatory developments, assess organizational impacts, and recommend updates to policies, procedures and practices to support ongoing compliance.
- Serve as the Board’s subject matter expert on FOI, privacy and information governance, providing strategic advice, legislative interpretation and recommendations to senior leaders, managers and administrators.
- Responsible for the leadership and supervision of staff, including hiring, determining work priorities, providing guidance and coaching, performance management, and professional learning and development.
- Manage the Unit budget, including forecasting, monitoring, expenditure reviews, and authorization and analysis of transactions.
- Manage the development, coordination and delivery of privacy and information governance training, awareness initiatives and education resources.
- Build collaborative relationships with internal and external stakeholders, including the IPC, to support investigations, compliance matters, and strategic initiatives.
- Prepare reports, briefing materials, presentations, and documentation related to FOI requests, privacy matters, compliance activities and program initiatives.
- Provide leadership in fostering equity and inclusiveness in the development and implementation of programs and services.

Qualifications
- University degree in a related field (e.g., Law, Public Administration, Information Management, Records Management, Business Administration, Political Science) with six years of progressively responsible experience providing leadership and expertise in freedom of information, privacy, information governance, compliance, legal or related functions in a public sector environment, or an equivalent combination of education and experience.
- Experience in FOI, privacy, information governance, compliance, legal, and records management.
- Expert knowledge of privacy management, information governance, records management, data protection, and privacy risk management frameworks.
- Expert knowledge of MFIPPA, IPC orders, guidance and privacy best practices.
- Demonstrated experience interpreting and applying MFIPPA, PHIPA, EDSTA and other applicable privacy, information management and access legislation.
- Proven ability to manage complex FOI requests, privacy investigations, PIAs and privacy risk assessments.
- Experience developing policies, procedures, training programs, and compliance frameworks for privacy programs.
- Proven supervisory experience with strong leadership, mentoring and team building skills.
- Strong research, analytical, project management and problem-solving skills.
- Ability to manage multiple complex priorities while meeting legislative requirements and statutory deadlines.
- Demonstrated ability to exercise sound judgment and manage sensitive and confidential matters with diplomacy and discretion.
- Strong interpersonal and oral and written communication skills, including report writing, presentation and stakeholder engagement.
- Proficient computer skills including word processing, spreadsheet and database applications, and presentation packages.
- Proven ability in promoting equitable practices which value inclusiveness and diversity.
Special Requirements
- May be required to work evenings and weekends sometimes with minimal or no notice to meet operational requirements.
- Occasional travel across TDSB.
